The Service Provider's authority to act and/or perform functions or duties is excluded in relation to the matters listed below. The provision of professional services in consortium / multi-disciplinary for engineering projects, located in the Eastern Cape for a period of three years. The provision of professional services in consortium / multi-disciplinary for engineering projects for the implementation of infrastructure in support of the Agri-parks program, production support (AVMP program) and socio-economic projects facilitated in support of the revitalization of rural towns and villages. Cooperatives and Enterprise Development (CED), Land Development Support (LDS), Tenure Implementation Systems (Tenure), Property Management and Restitution located in the Eastern Cape for a period of three years.
Description of services required
To provide a level 2 construction monitoring service for the technical aspects of the project as described in clause 3.3.2 of Board Notice 201 of 2012: Guideline Scope of Services and Tariff of Fees for Persons Registered in terms of the Engineering Profession Act, 2000 (Law No. 46 of 2000), as amended or supplemented in the project brief below. The provision of all services related to acting as the representative of the employer in terms of the Working Conditions Act, 1993 (Act No. 85 of 1993) and the Building Regulations, 2014 as set out in Article 3.3.3 of Board Notice 151 of 2014: Guidance for the scope of services and fees for registered persons in terms of the Engineering Profession Act, 2000 (Act No. 46 of 2000), as amended or supplemented in the project description below. By submitting this offer, the service provider is deemed to have acknowledged acceptance of the appointment as agent of the client in terms of the Occupational Health and Safety Act of 1993 (Act No. 85 of 1993) and the Building Regulations of 2014. the employer accepts the offer.
As such, the service provider must perform all the client's duties as envisaged in the building regulations. Will be expected to assist the client in contracting professionals and/or construction contractors in the built environment and manage such contracts on behalf of the employer.

Extent of the Services C3.3.1 All services as defined above
The Service Provider will always be expected to give priority to the execution of the work involved in this assignment. Notwithstanding any other requirements as listed elsewhere, the Service Provider will submit a monthly report indicating the progress of the Services. Upon approval and settlement of the final account of projects requiring a security clearance, it is a requirement that the Service Provider send all documents related to this service to the Employer.
The Service Provider's actions and their results will in no way harm the health and safety of passengers or persons in or near it. The Service Provider undertakes to ensure that the requirements of the Health and Safety at Work Act 1993 apply similarly to any agreement with any subcontractor, including indemnifying the Employer against any legal action in relation to their acts and/or omissions .
Security clearance
The Service Provider accepts full and complete responsibility (contractual and/or in tort) for compliance with the Health and Safety at Work Act 1993 (Act 85 of 1993) for its acts and omissions and for the acts and omissions of its employees and reimburses the employer for damages. against any legal action relating thereto. Access to land/buildings/sites should be negotiated in consultation with the Departmental Project Manager. The service provider must use the software that will be used in the project documentation for compatibility with other service providers and also with the employer.
Forms for contract administration (All disciplines)
It is an express condition of the contract that the Service Provider, after awarding the tender, accepts unregistered, qualified (built environment) persons in his office in order to expose the latter to the full extent of professional work, or as it may be. required under specific circumstances, to gain experience which can be presented to the relevant Council for consideration in relation to professional registration. The commitment of such unregistered persons will be negotiated with the Service Provider in terms of the number, training periods and scope of the professional work opportunity to be offered. The delivery conditions will be the subject of a separate Memorandum of Understanding with the Service Provider, which will serve as an annex to this document.
Any secondment arrangement will cease upon the professional registration of the seconded person or as agreed and thus included in the aforementioned memorandum of understanding. Responsibility for wages for expatriates remains with the employer, but responsibility for operating expenses necessary for the performance of the work rests with the service provider, all of which will be addressed in the memorandum of understanding.

Upon written approval, the PEP will form the basis for managing the assignment.
